Terms and Conditions

In this document, the following terms will be understood as:

“Seller” – CONDRA SRL, located at Bd. Tineretului, nr. 124, 915400, Oltenita, Calarasi County, registration number J51/549/1992 and unique registration code RO1932126, email: contact@condra.ro, phone: +40 723 654 566. “Client” – any person who has concluded a sales contract with the Seller for the purchase of the products marketed by the latter. “Consumer” – the person defined by the provisions of art. 2 point 2 of Government Ordinance no. 21/1992 regarding consumer protection, republished, with subsequent amendments and completions. Placing an order on the website www.condra.ro represents your agreement with the Terms and Conditions of CONDRA SRL.

Confidentiality

The information provided to CONDRA SRL is used only for the purpose for which it was entered (placing orders), in accordance with the laws in force. CONDRA SRL does not provide your email address to third parties, does not encourage spam, and does not publicly disclose the data provided by its clients without their explicit consent. Any user has the possibility to delete the email address provided from the database.

Information Note on Personal Data Protection

CONDRA SRL processes the personal data provided by you through this website and has the obligation to manage them safely and only for the specified purposes. Your data may be used in the future for advertising, marketing, and publicity operations only with your consent and will not be disclosed to third parties. According to Regulation (EU) no. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), you benefit from the right of access, intervention on data, right to delete data, right to restrict processing, right to data portability, right to object, right not to be subject to an automated decision-making process, right to withdraw your consent, and right to file a complaint with a supervisory authority. To exercise these rights, you can send a written, dated, and signed request to CONDRA SRL, Bd. Tineretului, nr. 124, Oltenita, postal code 915400, Calarasi County or to the email address contact@condra.ro.

In accordance with the requirements of Regulation (EU) no. 679/2016, the website www.condra.ro, managed by CONDRA SRL, has the obligation to manage safely and only for the specified purposes, the personal data you provide about yourself, a family member, or another person. For detailed information, please read the Privacy Policy and Cookie Usage Policy carefully.

Prices

Prices are expressed in Lei and include VAT. CONDRA SRL updates prices periodically. Prices in orders are valid for 5 days from the moment they are placed. No price update will affect confirmed orders for which a sales contract has been concluded.

In accordance with the provisions of art. 319 of Law no. 227/2015 regarding the Fiscal Code, the Client’s signature – as the buyer of the goods – is not a mandatory element of the content of the VAT invoice. It should be noted that if the individual buyer places an order or makes a purchase using data (e.g., providing the name/company) regarding the commercial activity carried out by this buyer, it will be assumed that the purchase is made by them in connection with such activity, and the invoice will be issued to this buyer as a professional.

Orders and Stocks

The content presented on the website www.condra.ro, especially advertisements, price lists, and other information, does not represent an offer in the sense of art. 1.188 of the Civil Code, but an invitation to submit offers in the sense of art. 1.189 of the Civil Code.

The sale of products takes place based on orders placed through www.condra.ro. To conclude a sales contract, Clients place an order by selecting the goods, colors, and sizes, and clicking on the "Add to Cart" button. The selected goods have not yet been ordered, and the Client has the option to add more goods to the cart, remove goods from there, as well as to abandon shopping.

After adding the goods to the cart, the Client has the option to remove them or add more goods. If the client has a discount coupon, they can enter it in the appropriate field of the form.

If the Client does not have an account, they can create one. If the Client has an account, they should log in to it and provide data to complete the order.

To complete the order, the Client will select the payment method and the delivery method. Next to the available delivery methods, the costs thereof are displayed.

On the order placement page, the price that includes the total amount the Client will be obliged to pay will be displayed, i.e., the price of the goods, delivery costs, and the selected payment method. The Client has the option to correct any errors in the order, modify it, or cancel it by returning to the cart content.

At this stage of placing the order, you must check its correctness and confirm it by clicking on the "Place Order" button. After placing an order, CONDRA SRL will send the Client an order confirmation and issue the related fiscal invoice, these resulting in the conclusion of a sales contract between CONDRA SRL and the Client.

Available payment methods from which you can choose are: online card payment, cash on delivery, or bank transfer, depending on the chosen delivery method. If you opt for online card payment, we inform you that recording the payment does not guarantee the confirmation and delivery of the order. If the order is not confirmed, the amount of money paid will be refunded to your account as soon as possible. If you opt for payment by bank transfer, please use the order ID as the payment reference. The order will not be delivered until the funds have been deposited in our account.

Product availability is displayed in real-time. However, product availability may change at any time during order processing.

If the ordered products are not available, we will contact you regarding the possibility of restocking the products and estimating the delivery time. Orders that include products that are not in stock and have not been resolved within 20 days from the date of placing them may be canceled by CONDRA SRL representatives.

Product Delivery

The delivery of products ordered by Clients will be made to the address specified by them at the time of placing the order. Delivery of products is available within Romania.

Delivery of products to the Client is free if the total value of the ordered products exceeds 150 EUR. If the total value of the ordered products is less than 150 EUR, a standard delivery fee of 20 Lei will be applied, which will be borne by the Client.

Delivery will be made through the courier company GLS.

The delivery term for the product to the Client is a maximum of 30 days from the conclusion of the sales contract, except when a shorter term was specified at the time of placing the order.

If the products have not been delivered within a maximum of 30 days from the conclusion of the sales contract, the Client may request delivery within an additional term. If the products are not delivered within the additional term, the Client may request the resolution of the contract.

The status of the order can be checked on the courier company's website.

The Client will check the integrity of the parcel at the time of receipt, in the presence of the courier, and will refuse acceptance or, as the case may be, request the drafting of a damage report if the products show signs of damage. Any subsequent claims will not be considered.

Granting Discounts

Discounts, reductions, and promotions are not cumulative. The highest value discount is always kept. The discount is calculated according to the discount formula accepted by the laws in force on the territory of Romania. The formula is: Final price = Initial price/((100+Discount)/100).

Conformity

Products sold through www.condra.ro are new, in the original packaging of the manufacturer, and are accompanied by a fiscal invoice at the time of delivery.

CONDRA SRL undertakes to deliver items without physical defects. If the products are incompatible with the sales contract (have physical defects), the Client has the right to submit a complaint regarding the goods within 2 years from the date of delivery of the item.

The legal guarantee of conformity covers the lack of conformity existing at the time of purchase of the product, not applying in the case of normal wear and tear or improper use of the products.

To benefit from the legal guarantee of conformity, the product must be sent to the Seller in the condition it was purchased, with all the internal labels sewn, glued, heat-sealed, or applied to the product.

Products are in conformity with the sales contract if they meet the following conditions in particular:

a) they comply with the description, type, quantity, quality, completeness, and functionality provided in the sales contract; b) they correspond to the purpose for which the Client purchased them, which the Client notified the Seller no later than at the time of concluding the sales contract and which the Seller accepted; c) they are suitable for the purposes for which products of this type are usually used, taking into account the laws, technical standards, or applicable best practices; d) they have the quantity and possess the characteristics, including durability and safety, that are typical for products of this type and that the Client can reasonably expect, taking into account the nature of the goods and the public statements made by the Seller or on its behalf, especially in advertisements or on the label, unless the Seller demonstrates that:

they did not know and could not reasonably know the public statement in question; before concluding the sales contract, the public statement was rectified in accordance with the conditions and form in which the public statement was made or in a similar manner to that in which it was made; the public statement did not have any impact on the Client's decision to conclude the sales contract; e) they come with the packaging, accessories, and instructions that the client can reasonably expect to receive; f) they are of the same quality as the sample or model that the seller made available to the Client before concluding the sales contract and correspond to the description of such a sample or model. The seller is not responsible for the non-conformity of the goods with the sales contract in the cases provided in lit. c) – f) above, if the Client, no later than at the time of concluding the sales contract, was clearly informed that a specific characteristic of the goods deviates from the conformity requirements with the sales contract and explicitly and separately accepted the lack of a specific characteristic of the goods.

If the goods are not in conformity with the sales contract, the Client may request their repair or replacement.

In the request for repair or replacement of the goods, the following must be provided in writing: the order number and date, the model, color, and size of the goods, the Client's contact details that allow a response to the submitted complaint, and a description of the event underlying the complaint, and sent by courier in a box together with the goods subject to the complaint to the contact details.

CONDRA SRL may choose whether to carry out a replacement or repair if bringing the goods into conformity with the sales contract in the manner chosen by the Client is impossible or would require excessive costs.

If repair and replacement are impossible or would require excessive costs for CONDRA SRL, it may refuse to bring the goods into conformity with the sales contract. When evaluating excessive costs for us, all circumstances are taken into account, especially the severity of the non-conformity of the goods with the sales contract, the value of the goods in accordance with the sales contract, and the significant inconveniences for the Client resulting from a change in the manner of bringing the goods into conformity with the sales contract.

CONDRA SRL carries out the repair or replacement within a reasonable period from the moment it was informed by the Client about the non-conformity of the goods with the sales contract and without unjustified inconveniences for the Client, taking into account the nature of the goods and the purpose for which the Client purchased them, but no later than 15 days from the moment the Client informed the Seller about the lack of conformity of the goods or from the moment the Client delivered the goods to the Seller or a third party designated by the Seller, based on a delivery report. Repair or replacement costs, including, in particular, postal costs, transport, labor, and materials, will be borne by the Seller.

The Client provides the Seller with the goods subject to repair or replacement. The Seller collects the goods from the Client at its own expense.

The Client may submit a statement of price reduction or withdrawal from the sales contract if the goods are incompatible with the sales contract:

a) the Seller refused to bring the goods into conformity with the sales contract; b) the Seller did not bring the goods into conformity with the sales contract; c) the non-conformity of the goods with the sales contract continues, despite the fact that the Seller tried to bring the goods into conformity with the sales contract; d) the non-conformity of the goods with the sales contract is significant enough to justify an immediate price reduction or withdrawal from the sales contract; e) the Seller's statement clearly shows that it will not bring the goods into conformity with the sales contract within a reasonable period or without unjustified inconveniences for the Client. The reduced price must be proportional to the price resulting from the sales contract, where the value of the goods non-conforming with the sales contract remains equal to the value of the goods in conformity with the sales contract. The refund of the amount due as a result of exercising the right to price reduction takes place within a maximum of 14 days from the date of receipt of the Client's statement regarding the price reduction.

The Seller cannot accept the Client's withdrawal statement from the sales contract if it proves that the non-conformity of the goods with the sales contract is irrelevant.

Instructions for Use and Maintenance of Products

Products sold by CONDRA SRL must be used, washed, and cleaned according to the instructions specified on their labels. These are specific instructions for the products and must be followed. Improper product selection and failure to follow maintenance rules may cause defects that cannot be claimed, as they occurred due to improper and non-recommended use by the manufacturer.

As general instructions for textile items, do not use industrial cleaning products, do not dry the product by placing it directly on heat sources, and protect the product from objects that could cause tears, pilling, burns, perforations, or any other actions that may cause damage.

Return Policy

According to the legislation in force, if the Client is a Consumer, they have the right to withdraw from the sales contract concluded with the Seller, complying with the conditions of OUG 34/2014 regarding the rights of consumers in contracts concluded with professionals. The Consumer has the right to notify the Seller in writing that they renounce the purchase, without penalties and without invoking a reason, within 14 days from the date the Client took possession of the good or the date a third party, other than the carrier and indicated by the Client, took possession of the goods. If the object of the sales contract consists of several items that are delivered separately, this period expires after 14 days from the date the Client took possession of the last item or the date a third party, other than the carrier and indicated by the Client, took possession of the last item.

Returned products must be in the same condition as they were delivered (in the original packaging with all accessories and documents that accompanied it, without physical modifications, bumps, scratches, etc.). The direct return costs of the products will be borne by the buyer.

In case of withdrawal from the sales contract, the Seller returns to the Client all payments received from them, including the delivery costs of the item to the Client (except for additional costs resulting from the delivery method chosen by the Client, other than the standard delivery method offered by the Seller), immediately and, in any case, no later than 14 days from the date of receipt of the Client's withdrawal statement from the sales contract. The Seller will refund the payment using the same payment methods used by the client in the initial transaction. If only part of the order is returned, the delivery costs are not refunded.

The right to withdraw from the sales contract does not apply if the object of the sales contract consists of items delivered in a sealed package, which cannot be returned after opening the package for health protection or hygiene reasons, if the package was opened after delivery, and neither in the case of goods made according to the specifications presented by the Consumer or clearly personalized.

To make a return, please contact us either by phone at the numbers listed on the site or by email at office@condra.ro. After contacting us, the products will be shipped to the address: Bd. Tineretului, nr. 124, Oltenita, postal code 915400, Calarasi County. We will not pick up parcels sent to another address, and we will not pick up parcels from post offices. For shipping parcels, please use the same courier service through which you received the products. We do not accept unwrapped products for return. The 14-day period in which we will refund the value of the products starts from the moment the returned products reach our possession.

Upon the arrival of the parcels in our specialized service, a brief visual inspection of the parcel will be made in the presence of the courier. If there are signs of bumps or improper handling of the parcel, or if its condition is not impeccable in terms of integrity, a report will be made to signal these issues, and a copy will be handed to the courier. All parcels received that comply with these return conditions will be unwrapped and photographed to record the condition at reception of the products inside and to verify if the condition of the products is identical to their condition at the time of completing the return form (at the time of completing the form, based on the assumption of responsibility, the client must state the condition of the products in writing and/or through photos). Any discrepancy between the condition declared by the consumer when completing the return form and the actual reception of the products by our specialized personnel will lead to the rejection of the return of the products, the client being responsible for transporting these products to our specialized headquarters.

The Client will be informed within 72 hours of receiving the parcel of this situation and will be able to choose whether to receive back at their expense the products that do not conform to their declaration and the products that are no longer in the same condition as they were initially delivered to the client, or whether to accept bringing these products to their initial condition. If the product is returned in a condition in which it can no longer be sold as new, our company has the right to request a fee for bringing it to the initial condition (if possible) or to cover the price difference resulting from the sale of the product as second-hand or, at the client's option, to resend the product, at their expense. The 72-hour period may be modified depending on factors independent of the company.

Alternative Dispute Resolution

The use of extrajudicial means for resolving complaints and appeals is voluntary. The consumer has the right to access extrajudicial methods for examining the complaint in accordance with OG no. 38/2015 regarding the alternative resolution of disputes between consumers and traders.

Detailed information on the consumer's possibilities to access extrajudicial methods for examining the complaint, complaint methods, and access conditions to these procedures are available on the website of the Consumer Protection Authority.

The consumer has the right to address the courts to request the cessation of any action of the Seller that violates the provisions of the law or compensation for the damage suffered.

Final Provisions

All elements on the website www.condra.ro (texts and images) are the property of CONDRA SRL and cannot be reproduced or copied without the written consent of the owner.

CONDRA SRL reserves the right to refuse collaboration with clients who display inappropriate behavior and language (aggressive, licentious, etc.) or have a history of refused deliveries.

CONDRA SRL reserves the right to make changes to these Terms and Conditions or to the website www.condra.ro without prior notice, these changes becoming mandatory and effective immediately for all Clients.
